Acceptance of Terms

By accessing or using Soraha ("the Platform", "we", "us", "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our platform.

These terms apply to all users, including students, teachers, guardians, tutors, and administrators. By creating an account or using our services, you confirm that you:

  • Have read and understood these Terms & Conditions
  • Have read and acknowledged our Privacy Policy
  • Agree to comply with all applicable laws and regulations
  • Are authorized to use the platform (or have obtained necessary consent if under 18)

Description of Service

Soraha is an educational gaming platform that provides:

  • Interactive educational games and question sets aligned with various curricula (CBC, British, IB)
  • Student performance tracking and analytics
  • Teacher and guardian dashboards for monitoring student progress
  • Badge and certificate systems to encourage learning engagement
  • Class and student management tools for educational institutions

We reserve the right to modify, suspend, or discontinue any aspect of our service at any time.

User Accounts & Responsibilities

Account Creation

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One person may not maintain multiple accounts without authorization

Student Accounts

  • Students must connect with either a teacher OR a guardian before accessing the platform
  • Students receive a PIN for secure access to their account
  • Students are responsible for keeping their PIN confidential
  • Students must use the platform only for educational purposes

Teacher/Guardian Accounts

  • Teacher Responsibility: Teachers MUST obtain explicit parental consent from parents/guardians BEFORE sharing connection codes with students. By providing a connection code to a student, teachers certify that they have obtained prior written or verbal consent from the student's parent or guardian for the child to use Soraha.
  • Teachers act in educational capacity with school authorization, but must ensure parental consent is obtained first
  • Guardians provide explicit parental consent for their children
  • All users must respect student privacy and use data only for educational purposes
  • Teachers are responsible for maintaining records of parental consent where required by their school or local regulations

Parental/Guardian Consent Requirement

Consent Mechanism: Students under 18 years of age must obtain consent from a parent, guardian, or authorized teacher before using our platform.

Connection-Based Consent

We use a connection-based consent model where:

  • Teacher Connection: When a student connects via a teacher's connection code, the teacher (acting in educational capacity with school authorization) provides consent for data processing. IMPORTANT: Teachers must have obtained explicit parental consent from the student's parent or guardian BEFORE sharing connection codes. By providing a connection code, teachers certify that they have obtained this prior consent. This is standard practice in Kenyan educational context where teachers act in loco parentis for educational activities, but parental consent must still be obtained first.
  • Guardian Connection: When a student connects via a guardian's link code, the guardian provides explicit parental consent for data processing.
  • Acknowledgment Required: Students must acknowledge that they have permission and understand the terms before using the platform.

Important: By connecting with a teacher or guardian, you confirm that you have obtained the necessary permission to use this platform. Parents and guardians can request access to or deletion of their child's data at any time.

Acceptable Use Policy

You agree NOT to:

  • Use the platform for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the platform
  • Share, distribute, or sell account credentials (PINs, passwords, connection codes)
  • Create fake accounts or impersonate others
  • Interfere with or disrupt the platform's functionality
  • Use automated systems (bots, scrapers) to access the platform without permission
  • Upload malicious code, viruses, or harmful content
  • Harass, bully, or engage in inappropriate behavior towards other users
  • Use the platform to cheat or manipulate performance data
  • Share student data outside the educational context for which it was intended

Violation of these terms may result in immediate account suspension or termination.

Intellectual Property Rights

Platform Content

All content on the Soraha platform, including but not limited to software, graphics, text, logos, and educational materials, is the property of Soraha or its licensors and is protected by copyright, trademark, and other intellectual property laws.

User-Generated Content

When you create questions, assessments, or other content on the platform:

  • You retain ownership of your original content
  • You grant Soraha a license to use, display, and distribute your content on the platform for educational purposes
  • You represent that you have the right to share such content

Performance Data

Educational performance data (scores, progress, analytics) belongs to the student and their authorized guardians/teachers, but may be aggregated anonymously for platform improvement purposes.

Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

By using our platform, you acknowledge that:

  • We collect and process personal data as described in our Privacy Policy
  • You consent to data processing for educational purposes
  • You have rights to access, correct, or delete your data (see Privacy Policy)
  • Data may be shared with authorized teachers and guardians for educational purposes

Limitation of Liability

To the maximum extent permitted by law:

  • We provide the platform "as is" without warranties of any kind, express or implied
  • We do not guarantee uninterrupted, secure, or error-free operation
  • We are not liable for any indirect, incidental, special, or consequential damages arising from platform use
  • Our total liability is limited to the amount you paid (if any) for platform access in the 12 months preceding the claim
  • We are not responsible for educational outcomes or academic performance of students
  • Teachers and guardians are responsible for appropriate use of student data

This limitation does not affect your rights under Kenya's Data Protection Act or other applicable laws.

Termination

Termination by You

You may stop using the platform at any time by requesting account deletion through our Data Management Dashboard.

Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms & Conditions
  • Engage in fraudulent or illegal activity
  • Fail to pay required fees (if applicable)
  • Create security risks or interfere with platform operation

Effect of Termination

Upon termination, your access to the platform will cease. You may request data deletion, and we will retain data only as required by law or for legitimate educational purposes.

Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of Kenya. Any disputes arising from these terms or your use of the platform shall be resolved:

  1. First: Through good faith negotiation between the parties
  2. Second: Through mediation in accordance with Kenya's dispute resolution procedures
  3. Finally: Through the courts of Kenya, which shall have exclusive jurisdiction

For data protection disputes, you may also file a complaint with the Office of the Data Protection Commissioner (ODPC) in Kenya.

Changes to Terms

We may modify these Terms & Conditions from time to time. When we make changes:

  • We will update the "Last updated" date at the top of this page
  • Material changes will be communicated via email or platform notifications
  • Continued use of the platform after changes constitutes acceptance of the updated terms
  • If you do not agree with changes, you may terminate your account
